The Public Utility Commission (PUC) Rate Order # 50788 recognized debt of $478,104.04 in incurred legal expenses by prior WOWSC boards. The WOWSC was ordered to apply a rate-case expense surcharge, per connection. ("The Commission approves a monthly surcharge of $39.21 per connection to recover the $478.184.04 in rate-case expenses Windermere incurred in this proceeding through January 31.2023." See: PUC Order #50788 page 32, Section V. Ordering Paragraphs, paragraph 4).
In advance of the current billing cycle, WOWSC took the additional step of written
communication with the PUC concerning application of the rate case legal surcharge
"per connection" as required by the express language of the PUC's Order. Additionally,
WOWSC invited PUC to timely provide any additional guidance or disagreement PUC
had concerning its "per connection" language. PUC did not disagree
with WOWSC's statements as to the PUC's intentional use of "per connection.” The
mandatory compliance required by the State of Texas in the PUC’s Rate Order #50788, is automatic and requires the rate-case surcharge to be applied per connection set forth
on WOWSC bills.

These Surcharges will be found on your Billing Statement, for each connection you
have.
